The High Court today cleared legal bars on continuing the proceedings of a case filed by the Anti-Corruption Commission (ACC) against former Communication Minister Barrister Nazmul Huda for lodging fake case against former Chief Justice Surendra Kumar Sinha.
“Rejected summarily,” said the High Court order.
The High Court division bench of Justice Md Nazrul Islam Talukder and Justice Kazi Md Ejarul Haque Akondo passed the order after holding hearing on a petition filed by Barrister Huda, pleading to quash the proceedings of the case.
The High Court also asked the lower court concerned to dispose of the ACC case within six months.
“Now there is no legal bar to continue proceedings of the case at the trial court concerned,” Deputy Attorney General (DAG) AKM Amin Uddin Manik said.
The court in its observation during the hearing said it is not right to tarnish the image of the judiciary by raising question against any judgement of the court. No step is expected which can stain the dignity of the apex court, the DAG said.
“The court also said filing such fake graft cases against any apex court judges is like a threat to the judiciary. He has challenged the judiciary by filing this case. We all have the responsibility to protect the dignity and image of the Supreme Court,” Deputy Attorney General (DAG) AKM Amin Uddin Manik added.
Barrister Nazmul Huda filed the case against former Chief Justice SK Sinha with Shahbagh Police Station on September 27, 2018, for allegedly demanding bribe from him and changing the judgement of a graft case which had already been disposed of.
The ACC after probing the case for one and a half years, found the allegations baseless and false, and filed the case against Nazmul Huda on February 20, 2020.
