The High Court (HC) on Monday declared the candidacy of Awami League-nominated candidate for Mymensingh-9 (Nandail upazila), Major (retd) Abdus Salam, valid after hearing a petition filed by the candidate challenging the cancellation decision of the Election Commission (EC).
An HC bench of Justice Md Abu Taher and Justice Md Saifur Rahman passed the order, said the defendant’s counsel Bashir Ullah.
The AL-backed candidate now doesn’t have any legal bar to contest the upcoming parliamentary election scheduled for January 7, he said.
The incumbent MP and also independent candidate from the constituency, Anwarul Abedin Khan Tuhin, submitted an appeal seeking cancellation of Salam’s candidacy to Mymensingh deputy commissioner and also returning officer (RO), Dider-E-Alam Mohammad Maksud Chowdhury, before the scrutiny.
In the appeal, he alleged that the AL-nominated candidate is a loan defaulter.
On December 3, the RO declared his candidacy valid after scrutinizing documents submitted earlier.
Aggrieved with this, the current lawmaker Anwarul Abedin submitted a petition with the EC seeking cancellation of Salam’s candidacy. The EC declared Salam’s candidacy illegal last Thursday.
The HC upheld the RO’s decision after hearing in this regard today.
