Notification banning Jamaat to be withdrawn Tuesday, says lawyer

 The notification banning Bangladesh Jamaat-e-Islami and its affiliate, Islami Chhatra Shibir, issued by the Ministry of Home Affairs less than four weeks ago, is set to be withdrawn on Tuesday, according to the party’s legal representative, Mohammad Shishir Monir.

During a press briefing at the Supreme Court on Monday, Monir confirmed that the process has been completed, and the ban’s revocation is expected to take place after the public holiday on Monday.

Monir expressed confidence in the withdrawal, suggesting that the initial ban may have been politically motivated, as Jamaat-e-Islami played a key role in opposing the current government’s actions.

Once the ban is lifted, the party plans to take legal steps to regain its registration, which was previously canceled by the Election Commission following a High Court ruling, he said.

Earlier, on August 1, the Ministry of Home Affairs issued a notification banning Bangladesh Jamaat-e-Islami, Chhatra Shibir, and all related organizations under anti-terrorism laws.

 

The notification stated: “Since, by the verdicts of several cases by the International Crimes Tribunal, Bangladesh Jamaat-e-Islami (formerly Jamaat-e-Islami/Jamaat-e-Islami Bangladesh) and its affiliate organization Bangladesh Islami Chhatra Shibir (formerly Islami Chhatra Sangh) have been deemed responsible for genocide, war crimes, and crimes against humanity committed during the Liberation War of 1971; and since, by the ruling of the High Court Division of the Supreme Court of Bangladesh, the registration of Bangladesh Jamaat-e-Islami as a political party has been canceled by the Election Commission and the Appellate Division of the Supreme Court has upheld the High Court’s ruling;

 

Earlier, a High Court ruling on August 1, 2013, declared the registration of Jamaat-e-Islami null and void. Subsequently, on December 7, 2018, the Election Commission (EC) issued a notification canceling the registration of Bangladesh Jamaat-e-Islami. Later, Jamaat-e-Islami appealed against the High Court ruling.

 

On November 19 of last year, the Appellate Division of the Supreme Court dismissed that appeal. Now, the party will file a petition seeking reconsideration of the Appellate Division’s order to regain its registration.
